Copyright
The Journal no longer requires contributors to assign copyright in the articles to the publisher (the English Folk Dance and Song Society). This practice was adopted primarily to ensure that the Society has the power to authorise further reproduction of the article in anthologies by online database services. A new form of agreement between contributors and the Society has now been introduced, which gives the Society the power to use the contribution in the ways it requires, and protects its interests, but leaves copyright in the articles with their authors. The Society retains, of course, copyright in the typographical arrangement of the articles in the Journal, in accordance with the terms of the Copyright, Designs and Patents Act 1988.
The form of the agreement is given below. Authors should note that it is their responsibility to obtain permission to reproduce quotations (except where covered by the fair dealing provisions of the Copyright, Designs and Patents Act 1988, or are out of copyright), illustrations, and archival or manuscript material.

1. By signing this form, you (the author(s) or other copyright owner) agree to grant to us (English Folk Dance and Song Society, the publisher) the exclusive right (subject to the exceptions listed in section 5 of this licence) for the duration of the respective copyrights involved both to reproduce and/or distribute your article (including the abstract) ourselves throughout the world in printed, electronic or any other medium, and in turn to authorise others (including Reproduction Rights Organisations such as the Copyright Licensing Agency and the Copyright Clearance Center) to do the same. You agree that we may publish your article in Folk Music Journal, and that we may sell or distribute it within the journal, on its own, or with other related material.
2. You promise that the article is your original work, has not previously been published, and is not currently under consideration by another journal. If it contains material which is someone else's copyright, you promise that you have obtained the necessary permission of the copyright owner (please attach evidence of this) and that the material is clearly identified and acknowledged within the text. You also promise that the article does not, to the best of your knowledge, contain anything which is libellous, illegal, or infringes anyone's copyright or other rights.
3. You assert your Moral Right to be identified as the author, and we promise that we will respect your rights as the author(s). That is, we will make sure that your name(s) is/are always clearly associated with the article and, while you do allow us to make necessary editorial changes, we will not make any substantial alteration to your article without consulting you.
4. Copyright remains yours, and we will acknowledge this in the copyright line which appears on your article. However, you authorise us to act on your behalf at our discretion to defend your copyright if anyone should infringe it by use of material originally lawfully published or authorised by us, and to retain half of any damages awarded, after deducting our costs.
5. You also retain the right to use your own article (provided you acknowledge the published original in standard bibliographic citation form) in the following ways, as long as you do not sell it or give it away in ways which would conflict directly with our commercial business interests. You are free to use your article in spoken presentations; to use it for the internal educational or other purposes of your own institution or company; to mount it on your own or your institution's website; and once twelve months have elapsed from publication by us, to post it to free public servers of articles in your subject area; or to use it in whole or in part as the basis for your own further publications.
6. This agreement lapses if we do not publish your article within three years from the end of the year in which we accept your article for publication.
7. You and your personal representatives will indemnify us against all losses costs damages and expenses arising because of a breach by you of this Licence.
8. This Licence is governed by the laws of England and all parties shall submit to the jurisdiction of the English courts.
